1. Acceptance of Terms
By accessing or using the Inkuity platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Service. These terms apply to all users, including gym owners, administrators, staff members, and gym members.
2. Description of Service
Inkuity provides a cloud-based gym management platform. The Service includes, but is not limited to:
- Customizable QR code generation for member check-ins
- Member management, tracking, and membership status management
- Analytics dashboards with check-in trends, device breakdowns, and visit patterns
- A member portal for members to view check-in history, workouts, and AI calorie tracking
- AI-powered calorie tracking using third-party artificial intelligence services
- Workout routine and exercise management
- Custom fitness trackers and personal records logging
- Push notifications for meal, workout, and tracker reminders
- Staff and role management for gym teams
- Payment and expense tracking
- Announcement and notification delivery to members
- Member referral programs
- Feedback and review collection
- Progressive Web App (PWA) with offline capabilities
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. User Types and Accounts
The Service supports the following user types:
- Gym Owners: Register with email and password or Google Sign-In. Responsible for managing their gym, members, staff, and data.
- Staff Members: Invited by gym owners with specific roles (manager, trainer, receptionist, etc.). Access is limited to the associated gym's data.
- Gym Members: Access the member portal via email and a 4-digit PIN. Members do not create traditional password-based accounts.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials (including PINs) and for all activity that occurs under your account. Notify us immediately at contact@inkuity.com if you suspect unauthorized access.
4. Member Portal and PIN Authentication
Gym members access the member portal using their email address and a 4-digit PIN provided by their gym. PINs are encrypted and sent to the member's email for verification. By using the member portal, you consent to receiving PIN verification emails. PIN-based sessions remain active for 30 days unless you sign out.
5. QR Code Scanning and Analytics
When you scan a gym's QR code, we automatically collect technical data including your IP address, device type, browser, operating system, and referral information. This data is used to provide check-in functionality and generate analytics reports for gym owners. By scanning a QR code, you consent to this data collection.
6. AI-Generated Content
The Service offers AI-powered calorie tracking using third-party artificial intelligence services. By using this feature, you acknowledge and agree that:
- AI-generated calorie and nutrition data are for informational purposes only and do not constitute medical, nutritional, or health advice
- Your personal data (including age, gender, height, weight, dietary preferences, allergies, and fitness goals) will be sent to our AI service provider for processing
- AI-generated content may contain inaccuracies and should be reviewed by a qualified professional before following
- You should consult a healthcare provider or registered dietitian before making dietary changes, especially if you have medical conditions or allergies
- Inkuity is not liable for any health consequences resulting from following AI-generated recommendations
- Usage of AI features may be rate-limited
7. Health and Fitness Data
The Service allows you to log health and fitness information including workout routines, personal records, body measurements, dietary preferences, allergies, and fitness goals. This information is considered sensitive personal data. By providing this data, you consent to its collection, storage, and processing as described in our Privacy Policy. You are responsible for the accuracy of the health information you provide.
8. Push Notifications
The Service may send push notifications for meal reminders, workout reminders, and tracker alerts. By enabling push notifications, you consent to receiving these messages. You may disable notifications at any time through the member portal settings or your browser settings.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code, viruses, or harmful content
- Scrape, harvest, or collect data from the Service without permission
- Impersonate another person or entity
- Circumvent rate limiting, bot protection, or other security measures
- Share, distribute, or transfer your PIN or login credentials to others
- Use AI features to generate content for commercial redistribution
- Abuse the referral program through fraudulent or duplicate referrals
10. Gym Owner Responsibilities
If you are a gym owner using the Service, you are responsible for:
- Ensuring you have appropriate consent to collect and store your members' personal data
- Informing your members that their data is processed through the Inkuity platform
- Accurately recording member information and payment records
- Managing staff access permissions appropriately
- Using the blacklist feature responsibly and in compliance with applicable laws
- Ensuring announcement content complies with applicable laws and does not contain harmful content
11. Data Ownership
You retain ownership of all data you upload to the Service, including gym logos, member information, and user-generated content. By using Inkuity, you grant us a limited, non-exclusive license to process, store, and transmit your data solely to provide and improve the Service. We do not sell your data to third parties.
12. Third-Party Services
The Service relies on third-party providers for core functionality, including cloud hosting, email delivery, analytics, error monitoring, bot protection, and AI processing. Your use of the Service constitutes acceptance of the terms and privacy policies of these providers. We are not responsible for the practices of third-party services. 13. Payment and Billing
Certain features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be communicated at the time of purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days notice. The Service provides payment tracking tools for gym owners to record member payments; Inkuity does not directly process credit card payments or store sensitive financial information.
14. Referral Program
The Service may offer a member referral program. Referral rewards and eligibility are determined by the gym owner. Fraudulent or duplicate referrals may result in disqualification from the program and potential account suspension.
15. Account Restrictions and Blacklisting
Gym owners may restrict or blacklist members from their gym for valid reasons. Blacklisted members will be notified of their status and the reason provided by the gym owner. Blacklisting only affects access to the specific gym and does not impact your Inkuity account or access to other gyms on the platform.
16. Intellectual Property
All content, trademarks, logos, and software associated with Inkuity are the property of Inkuity Inc. You may not reproduce, modify, or distribute any part of the Service without our prior written consent. AI-generated content (such as calorie and nutrition data) is provided for your personal use and should not be commercially redistributed.
17. Limitation of Liability
To the maximum extent permitted by law, Inkuity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages arising from AI-generated content, health or fitness recommendations, data loss, or service interruptions. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
18. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. Health and fitness features, including AI-generated calorie tracking, are not substitutes for professional medical advice, diagnosis, or treatment.
19. Termination
We may suspend or terminate your account if you violate these terms. You may also delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately. We will delete or anonymize your personal data within 30 days of termination, except where retention is required by law. Gym owners are responsible for informing their members if they discontinue using the Service.
20. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in India.
21. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or a notice on the Service. Continued use after changes constitutes acceptance of the updated terms.
